THIS CONTRACT CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED IN THE ARBITRATION AND CLASS ACTION WAIVER SECTION BELOW.

Welcome to Rent Butter, Inc. (“RentButter,” “we,” “our,” or “us”)’s services portal (the“Site,” or where available via mobile device, the “App”). Through the Site or App, You (as defined below) will have the ability to use the services provided via the Site which are specific to Your authorization level (“Services”). By clicking “I Agree” and accessing or using this Site or the App, You agree to follow and be bound by the following terms and conditions concerning Your access to and use of the Site and the App (“Terms of Use”). If You do not agree to these Terms of Use, continued use of the Site or App by You is not authorized.

These Terms of Use apply to, and “You” or “Your” as used in these Terms of Use cover, all Rent Butter customers and users of the Site or App, including but not limited to (a) individuals, rental management companies, and similar organizations who utilize the Services to determine a prospective renter’s eligibility to rent real estate; (b) others who access the Services, including but not limited to visitors to the Site, users of the App, and users of other websites or on-line services which allow access to Rent Butter Services; and (c) each User (as defined below) and such User’s assigns and successors. Any person who uses the Services on behalf of a business entity (“User”) hereby represents and warrants that he or she has the authority to bind that business entity. As such, a User’s acceptance of the Terms of Use will be deemed an acceptance by that business entity, and “You” and “Your” as used in these Terms of Use shall refer to that entity.

Rent Butter may revise the Terms of Use at any time by posting the changes on the Site. The revised Terms of Use will be effective fifteen (15) days after they are posted to the Site. The most current version will be available on the Site, and the Effective Date of the current version is at the top of the Terms of Use. By continuing to access or use the services after revisions to the Terms of Use become effective, You agree to be bound by the revised Terms of Use, except as provided in the Arbitration and Class Waiver section below.

1. Prospective Renters

1.1 Use of the Site or App

The purpose of the Services for individuals looking to qualify for rental properties (“Prospects”) is to enable You, as a Prospect, to submit information (“Submissions”) to engage Rent Butter Services offered through the Site or App. Use of this Site or the App does not create a rental relationship between You and Rent Butter, or any Rent Butter client. You expressly agree that no rental relationship will be created without, at a minimum, further review of the Submission, an appropriate successful application process, background and reference checks (where applicable), verification of identity, and issuance and acceptance of a formal written rental agreement from the entity offering the rental property.

1.2 Electronic Signatures

By using the Services and providing Submissions, You agree to transact electronically through the Site or App. You agree that Your electronic signature is the legal equivalent of Your physical signature. You further agree that Your use of a key pad, mouse or other device to select an item, button, icon or similar act/action, constitutes Your signature as if actually signed by You physically in writing. You also agree that no certification authority or other third-party verification is necessary to validate Your electronic signature, and the lack of such certification or third-party verification will not in any way affect the enforceability of Your electronic signature.

In order to access, fulfill and retain any electronic forms You receive or sign, Your computer must be equipped and compatible with the most common operating systems and internet browsers. This would include:

• Windows, Mac OS X, Linux, Apple iOS, and other major operating systems.
• Microsoft Internet Explorer version 8 and later, Mozilla Firefox - latest version, Safari latest version + tablet versions, Chrome latest desktop version.                    

If You decline to use an electronic signature, You will be able to print Your forms and sign them by hand, but will also be required to deliver the hand signed forms to Rent Butter via US Postal Service or national courier service like Federal Express.

If You wish to obtain a paper copy of the forms You sign via the Site or App, You will be given the opportunity to download and print those forms once they have been executed.

After authorizing the use of Your electronic signature, You may still withdraw Your consent. To do so, You must contact Rent Butter for their withdrawal procedures and to understand any consequences or fees which may apply.

1.3 Consent for Communications

By providing Your telephone number, You are providing express written consent to receive communications from Rent Butter, (including its affiliates, agents, and service providers for the purposes described above) for any purpose, including but not limited to marketing various services from both Rent Butter and companies Rent Butter ha joint marketing agreements with. Additionally, You agree to receive communications from Rent Butter regarding any Service, and any information You may have obtained via Your use of the Site or App. You agree that these communications include, but are not limited to, the use of an Automated Telephone Dialing System, prerecorded and/or artificial voice, SMS, MMS, text, fax, email or other similar means. Note, regardless of whether Your phone number is registered on a state or federal Do Not Call list. You agree that Rent Butter is not responsible for any charges to You regarding these communications. Standard voice and data rates may apply. Further, You understand that You do not need to provide this consent to call as a condition to receive any good or service, in which case You will not provide Your phone number.

1.4 Submissions

By making Submissions, You warrant that: (a) You have the right and authority to provide any Submissions, or instruct any third party to provide Submissions on your behalf; (b) You have only provided, or instructed for the provision of, information that is true, accurate and not misleading (including by omission) and nothing You have submitted is known by You to be false, inaccurate, or misleading; (c) You have a legal right to live in the jurisdiction in which You are applying for a rental. If that legal right is limited in time, You have disclosed when it expires; (d) You are the individual who the Submissions relate to; and (e) Your Submissions, or any offer to enter into a rental contract that may result from Your Submissions, would not infringe any legal obligation that You may have to any third party.

1.5 Background Reports

You authorize Rent Butter to:

• Collect and share information for rental eligibility
• Provide data to potential landlords
• Monitor submitted data sources

All use complies with the Fair Credit Reporting Act (FCRA).

Knowingly obtaining information under false pretenses may result in criminal penalties.

1.6 Acceptable Use

You may not submit content that:

• Is abusive, defamatory, or harassing
• Violates privacy or intellectual property
• Promotes hatred or discrimination
• Contains malware or harmful code

Violations may be reported to authorities.

1.7 Security & Access

You agree not to:

• Attempt unauthorized access
• Interfere with system operations
• Use bots or scrapers without permission

You are responsible for safeguarding your login credentials.

2. Users

2.1 Use of Site

The Site allows Company clients to evaluate Submissions. Users must comply with all applicable laws, including the FCRA.

2.2 Electronic Signatures

Users agree electronic signatures are legally binding and enforceable.

2.3 Consent for Communications

Same communication consent applies as outlined in Section 1.3.

2.4 Submissions

Users certify compliance with all disclosure and authorization requirements under federal, state, and local law.

Before adverse action, Users must provide:

• A copy of the report
• A Summary of Rights under the FCRA

2.5 Acceptable Use

Same restrictions as outlined in Section 1.6 apply.

2.6 Security & Access

Users must protect passwords and notify Company of unauthorized access immediately.

3. General Terms

3.1 Reservation of Rights

All Site content is owned by Company or licensors and provided “as is.”

3.2 Indemnity

You agree to indemnify Company against claims arising from:

• Your Submissions
• Violations of these Terms
• Infringement of third-party rights

3.3 Monitoring

Company may monitor, review, or remove content at its discretion.

3.4 Termination

Company may terminate or restrict access at any time without liability.

3.5 Third-Party Content

Company is not responsible for third-party websites or services.

3.6 Disclaimer

Services are provided “as is” without warranties of any kind.

3.7 Limitation of Liability

Company is not liable for indirect, incidental, or consequential damages.

3.8 Exclusions

Some jurisdictions limit disclaimers; remaining terms remain enforceable.

3.9 Age Requirement

Users must be 18 years or older.

3.10 Waiver & Severability

Invalid provisions do not affect enforceability of remaining Terms.

3.11 Governing Law

These Terms are governed by Illinois law, except arbitration provisions.

4. Arbitration & Class Action Waiver

PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

All disputes must be resolved through binding arbitration on an individual basis.

You waive the right to:

• Jury trials
• Class or collective actions

Arbitration is governed by the Federal Arbitration Act and administered by the American Arbitration Association (AAA).
