THIS CONTRACT CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED IN THE ARBITRATION AND CLASS ACTION WAIVER SECTION BELOW.

Welcome to Rent Butter’s (“Company”) services portal (the “Site,” or where available via mobile device, the “App”).

Through the Site or App, you (“You”) may use services provided based on your authorization level (“Services”). By clicking “I Agree” and accessing or using the Site or App, you agree to be bound by these Terms of Use. If you do not agree, continued use is not authorized.

These Terms apply to all users of the Site or App, including but not limited to:

• Individuals
• Rental management companies
• Visitors to the Site
• Users of affiliated services

Any person using the Services on behalf of a business entity represents they have authority to bind that entity.

Company may revise these Terms at any time. Updated Terms become effective 15 days after posting.

1. Prospective Renters

1.1 Use of the Site or App

The Services allow individuals seeking rental qualification (“Prospects”) to submit information (“Submissions”). Use of the Site does not create a rental relationship.

A rental relationship may only be formed after:

• Review of Submissions
• Successful application
• Background and reference checks
• Identity verification
• Execution of a written rental agreement

1.2 Electronic Signatures

By using the Services, you agree to transact electronically. Your electronic signature has the same legal effect as a physical signature.

Accepted systems include:

• Windows, macOS, Linux, iOS
• Internet Explorer 8+, Firefox, Safari, Chrome

You may opt out by printing and mailing signed forms. You may withdraw electronic consent by contacting the Company.

1.3 Consent for Communications

By providing a phone number, you consent to receive communications from Company and its affiliates, including:

• Calls (automated or prerecorded)
• SMS / MMS
• Email
• Fax

Standard rates may apply. Consent is not required to receive services.

1.4 Submissions

By submitting information, you warrant that:

• You have authority to provide it
• Information is accurate and not misleading
• You have legal right to reside where applying
• Information relates to you
• No third-party rights are violated

1.5 Background Reports

You authorize Rent Butter to:

• Collect and share information for rental eligibility
• Provide data to potential landlords
• Monitor submitted data sources

All use complies with the Fair Credit Reporting Act (FCRA).

Knowingly obtaining information under false pretenses may result in criminal penalties.

1.6 Acceptable Use

You may not submit content that:

• Is abusive, defamatory, or harassing
• Violates privacy or intellectual property
• Promotes hatred or discrimination
• Contains malware or harmful code

Violations may be reported to authorities.

1.7 Security & Access

You agree not to:

• Attempt unauthorized access
• Interfere with system operations
• Use bots or scrapers without permission

You are responsible for safeguarding your login credentials.

2. Users

2.1 Use of Site

The Site allows Company clients to evaluate Submissions. Users must comply with all applicable laws, including the FCRA.

2.2 Electronic Signatures

Users agree electronic signatures are legally binding and enforceable.

2.3 Consent for Communications

Same communication consent applies as outlined in Section 1.3.

2.4 Submissions

Users certify compliance with all disclosure and authorization requirements under federal, state, and local law.

Before adverse action, Users must provide:

• A copy of the report
• A Summary of Rights under the FCRA

2.5 Acceptable Use

Same restrictions as outlined in Section 1.6 apply.

2.6 Security & Access

Users must protect passwords and notify Company of unauthorized access immediately.

3. General Terms

3.1 Reservation of Rights

All Site content is owned by Company or licensors and provided “as is.”

3.2 Indemnity

You agree to indemnify Company against claims arising from:

• Your Submissions
• Violations of these Terms
• Infringement of third-party rights

3.3 Monitoring

Company may monitor, review, or remove content at its discretion.

3.4 Termination

Company may terminate or restrict access at any time without liability.

3.5 Third-Party Content

Company is not responsible for third-party websites or services.

3.6 Disclaimer

Services are provided “as is” without warranties of any kind.

3.7 Limitation of Liability

Company is not liable for indirect, incidental, or consequential damages.

3.8 Exclusions

Some jurisdictions limit disclaimers; remaining terms remain enforceable.

3.9 Age Requirement

Users must be 18 years or older.

3.10 Waiver & Severability

Invalid provisions do not affect enforceability of remaining Terms.

3.11 Governing Law

These Terms are governed by Illinois law, except arbitration provisions.

4. Arbitration & Class Action Waiver

PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

All disputes must be resolved through binding arbitration on an individual basis.

You waive the right to:

• Jury trials
• Class or collective actions

Arbitration is governed by the Federal Arbitration Act and administered by the American Arbitration Association (AAA).
